Jim Sarnecky's practice focuses upon intellectual property and other commercial litigation.  His litigation and trial experience includes actions involving claims of trademark infringement and trademark dilution, copyright infringement, trade secret misappropriation, and patent infringement.  Mr. Sarnecky also has significant experience litigating business disputes involving a variety of commercial claims.

Representative Cases

  • Obtained favorable verdict for Fortune 100 company in 30 day jury trial in Los Angeles as trial counsel regarding fraud, breach of contract, and breach of warranty claims; argued appeal from trial at California Second District Court of Appeal;
  • Represented high technology company in patent infringement action before U.S. International Trade Commission; responsible for all aspects of infringement claims related to personal computer technology and argued claims construction issues at Markman hearing before ITC;
  • Defended on-line retailers from claims of patent infringement related to electronic catalog systems and methods;
  • Represented gaming industry client in trade secret misappropriation case against competitor and former programmer related to computer system for collating and managing off track betting events;
  • Defended company against claims brought by major foreign automobile company regarding cybersquatting, trademark infringement and trademark dilution;
  • Represented internationally known athletic apparel company in trademark infringement and trademark dilution actions against counterfeiters and infringers;
  • Defended financial and information services company against patent infringement claims regarding systems and methods for managing medical claims in insurance context;
  • Defended companies against copyright infringement claims related to business to business software applications;
  • Defended copyright infringement claim related to software for managing large scale industrial and construction projects;
  • Defended client against trade secret misappropriation claims related to construction industry inspection and quality assurance processes.

Authorship

Mr. Sarnecky is the co-author of Evolution of the Economic Loss Doctrine in Information Age Disputes, published in the Defense Counsel Journal, April 2006.
